It has been very clear to us that many tenants and landlords are subject to financial hardship during these unprecedented times.  Our approach has been to act with compassion and discretion in managing arrears and requests for rent relief. Our intention is to keep you as informed and supported as we can during these tough times. However, we are still awaiting government advice ahead of processing most requests and have also advised parties to lean on the current support mechanisms provided by National Treasury.

National Cabinet Mandatory Code of Conduct

The National Cabinet has established a mandatory Code of Conduct (“the Code”) outlining commercial leasing principals during COVID-19 for small to medium enterprises.  The Code imposes a set of good faith leasing principles to assist with the management of cashflow for small to medium enterprise tenants and landlords on a proportionate basis, as a result of the impact and commercial disruption caused by the economic impacts of industry and government responses to the declared Coronavirus (“COVID-19”) pandemic.

The Code applies to owners/operators/other landlords and tenants in commercial tenancies, where the tenant is an eligible business for the purpose of the Commonwealth Government’s JobKeeper program.
